PGTS Standard

2. Current signed conflict of interest statements are on file for the controlling board/committee members and all PGTS personnel performing any discretionary trust /estate management or development functions. (NADWP E 85 25 and S 85 20) [PGO, PGP, PGTS]

In the context of Planned Giving & Trust Services (PGTS), who must sign a Conflict of Interest Statement when making decisions on behalf of or working for the PGTS department?

Generally, this list includes all persons who have authority to exercise discretionary, decision making, development, and/or fiduciary duties in connection with Planned Giving & Trust Services.

Those Who Must Sign COI For PGTS

  • All certified PGTS personnel who are employed by the organization, working directly on behalf of PGTS, no matter where they are domiciled
  • Those persons in the PGTS office who only exercise ministerial duties on the behalf of your trustors and/or annuitants under the supervision of someone with discretionary authority and are non-exempt employees.
  • Treasury employees who are involved in PGTS trust accounting and or trust transactions
  • All Trust Management Committee/Trust Administration Committee members
  • All legal entity board members
  • All volunteers who work directly with PGTS

Those Who Need Not Sign COI For PGTS

  • Non-exempt employees who have no connection to PGTS transactions
  • Exempt employees who have no connection to PGTS.
  • Executive Committee members who are not on the legal board
  • Volunteers who have no connection with PGTS

The above lists are narrowly focused on COI statements specifically required for the PGTS Department Accreditation and Trust Review. Some who are excluded from the PGTS Standard will still need to sign a COI statement for the larger organization to comply with other NAD Working Policies.
